THE HON'BLE Dr. JUSTICE G. RADHA RANI CRIMINAL PETITION No.13939 OF 2024 ORDER:

This criminal petition is filed by the petitioner - accused No.4 under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of anticipatory bail in Cr.No.727 of 2024 of Police Station Film Nagar, Hyderabad registered for the offences under Sections 85, 108 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

2. Heard Sri Dr.GVNRSSS Vara Prasad, learned counsel for the petitioner and learned Additional Public Prosecutor for respondent-State.

3. Learned counsel for the petitioner-A4 submitted that the petitioner was the wife of A3 and she was the co-sister of the deceased. There were no specific allegations made against the petitioner except mentioning her name and making some omnibus allegations by the complainant, the mother of the deceased stating that the petitioner also along with her husband and others harassed the deceased for being childless and for not allowing the deceased to have contact with her kid aged about 10 months old.

3.1. He further submitted that the 10 months old child of the petitioner - A4 was always with the deceased and filed photographs showing the deceased along with the child. He further submitted that the petitioner - A4 does not even know any of the Indian languages. She belonged to Thailand and prayed for grant of anticipatory bail to the petitioner.

Learned Additional Public Prosecutor opposed grant of anticipatory bail to the petitioner.

Considering that there were no specific allegations made against the petitioner about harassing the petitioner physically or mentally attracting the offence under Section 85 of BNS, or that she committed the offence of abetment of suicide by the deceased attracting the offence under Section 108 of BNS, it is considered fit to grant anticipatory bail to the petitioner.

6. In the result, the Criminal Petition is allowed and the petitioner-A4 shall be released on anticipatory bail subject to the following conditions:

i) The petitioner-A4 is directed to surrender before the XVII Additional Metropolitan Magistrate Court, Nampally, Hyderabad, within a period of 15 days from the date of this order and on such surrender, the said Magistrate shall release the petitioner on bail, on her executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the concerned Magistrate.

ii) The petitioner-A4 shall abide by the conditions stipulated in Section 482 (2) of Bharatiya Nagarik Suraksha Sanhitha, 2023.
