G.Peeravali Reddy S/O Late Venkata Reddy, v. The Tahsildar, Kondapuram Mandal,
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.18795 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner. Nobody appears for the learned Government Pleader for Revenue. On the earlier occasion, the learned Government Pleader for Revenue was required to get instructions regarding the appeal pending with the 3rd respondent. However, no instructions are forthcoming.
The petitioner states that against the endorsement of the 1st respondent, dated 18-03-2014 denying his claim for grant of pattadar pass books for the land admeasuring Ac.6-56 cents in Sy.No.666 of Renamala H/o.Nekunampeta village, Kondapur Mandal, Nellore District, he has preferred an appeal before the 3rd respondent and the 3rd respondent vide order dated 08-07-2014 returned the appeal on the ground that the petitioner has not filed certified copy of endorsement issued by the 1st respondent. Though the petitioner has filed certified copy of the endorsement of the 1st respondent, there is no progress in the appeal and the appeal is neither numbered nor any date of hearing is fixed.
The petitioner's appeal is required to be considered by the 3rd respondent by fixing a date of hearing and after notice to the parties concerned.
Since the appeal is stated to be pending for the last one year, I deem it appropriate to direct the 3rd respondent to fix an early date of hearing of the appeal and hear and dispose of the same expeditiously, preferably within three months from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
