ORDER
This writ petition is filed seeking the following relief: "....to issue order or direction more particularly one in the Writ of Mandamus to set aside Memo No.1192/AH(1)/2016, dated 02.03.2017 on the file of the 1st respondent and consequential memo L.Dis. No.1828/BI/B2/2016, dated 21.03.2017 on file of the 2nd respondent by holding the same as non-application of mind, unjust and unreasonable and consequently direct the respondent Nos. 1 & 2 to issue orders by stepping up of pay of the petitioner on par with the 3rd respondent pay w.e.f 01.02.2007 with consequential benefits and to pass such other order or orders as this Hon'ble Court may deem fit and proper."
Heard Sri M.Venkat Ram Reddy, learned counsel appearing for the petitioner, and learned Government Pleader for Services-III appearing for respondents 1 and 2. The petitioner is working as Administrative Officer. His grievance is that the 3rd respondent, who is his junior and is working as Office Superintendent, is drawing higher salary than him. Hence, he submitted a representation on 17.2.2016 to the Joint Director, who, in turn, forwarded the same to the 2nd respondent. Thereafter, the 2nd respondent sent the same to the 1st respondent, who is the competent authority, for consideration of his case for stepping up of pay. The 1st
respondent vide Memo dated 2.3.2017 rejected his request. Hence, the present writ petition is filed.
Learned counsel appearing for the petitioner submits that the 1st respondent may be directed to consider the proposals submitted by the 2nd respondent.
Learned Government Pleader appearing for respondents 1 and 2 submits that the 1st respondent is the competent authority for stepping up of the pay of the petitioner and the 2nd respondent submitted proposals to the 1st respondent and that the 1st respondent would consider the proposals submitted by the 2nd respondent and pass appropriate orders. Having considered the rival submissions made by the learned counsel on either side, this Writ Petition is disposed of directing the 1st respondent to re-consider the proposals submitted by the 2nd respondent and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. No costs.
Miscellaneous petitions, if any, pending shall stand closed.
