THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE MRS. JUSTICE ANIS WRIT PETITION No. 26384 OF 2005 O R D E R: (per Hon'ble Sri Justice Nooty Ramamohana Rao) This Writ Petition is instituted by a constable of the Armed Reserve Police, Karimnagar. He sought for a writ of mandamus for directing the respondents not to proceed with the disciplinary enquiry initiated against him on 21.10.2012.

Entertaining this Writ Petition, in view of the judgment rendered by the Supreme Court in S. Govinda Menon v. Union of India (AIR 1967 SC 1274), this Court declined to grant any interim order. The learned Government Pleader for Services (Telangana) has drawn our attention to the order dated 10.02.2008 passed by the disciplinary authority imposing the punishment of reduction in time scale of pay by two stages for a period of two years with effect on future increments and pension. Even that two-year period was over reckoned from February 2008.

Hence, we consider that the cause in this Writ Petition does not survive for further adjudication. Since none appeared for the petitioner, we also infer that the petitioner has no further interest to pursue this Writ Petition.

Therefore, preserving liberty to the petitioner to pursue the legal remedy available to him against the order of punishment, we dismiss this Writ Petition. No costs.

Consequently, the miscellaneous applications, if any shall also stand dismissed.
