HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.13753 OF 2016 ORDER:

The petitioner is the owner of the Plot Nos.2 and 3 of Tetali Village, Tanuku Mandal, West Godavari District and having an electricity service connection No.546 of Category -III. Petitioner is also a tenant of Plot No.5 and he has also certain rights over the property on account of the mortgage executed by the 6th respondent in his favour. For the last two decades, the petitioner has been using the electricity drawn from S.C.No.546 to run ancillary unit in Plot No.5. At the instance of the 6th respondent who is the original owner and landlord and to coerce the petitioner, the 6th respondent approached the other respondents and the respondents 1 to 5 even without issuing any notice had disconnected the power supply to the unit located in Plot No.5. Thereafter, the petitioner had submitted a detailed representation to the respondents-authorities explaining about the disputes pending between the petitioner and the 6th respondent.

The learned counsel for the petitioner submits that a direction may be given to the respondents-authorities to consider the representation dated 18.04.2016 of the petitioner and pass appropriate orders.

As can be seen from the material on record, it is clear that the petitioner had submitted a representation on 18.04.2016 and also the petitioner got issued a legal notice dated 14.04.2016 through his lawyer. Under these circumstances, without expressing any opinion on merits, the writ petition is disposed of directing the respondents 1 to 5 to consider the representation dated 18.04.2016 submitted by the petitioner and pass appropriate orders within a period of four weeks from the date of receipt of copy of this order and communicate the same forthwith to the petitioner. Subject to the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous.
