HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12980 OF 2009 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the respondents in creating artificial breaks in service of the petitioners for every 10 months; in not paying salaries for the summer vacations and not regularizing the services of the petitioners from the date of appointment as contract residential teachers, as illegal and arbitrary, and consequently, to direct the respondents to regularize the services of the petitioners from the dates of their appointment as Contract Residential Teachers with all consequential benefits.

Heard Sri D. Balakishen Rao, learned Counsel for the petitioners and the learned Government Pleader for Social Welfare.

It is the case of the petitioners that they were all appointed as Contract Residential Teachers during the years 2003, 2004, 2005 and 2007 and they are fully eligible and qualified to be appointed as regular teachers in the schools run by the respondents. But the respondents are not considering their cases for regularization.

The learned Counsel for the petitioners submitted that the issue raised in this writ petition is squarely covered by the judgment passed by the Hon'ble Division Bench of this Court in

AKS,J W.P.No.12980/2009 W.P.Nos.19956 and 20036 of 2008 dated 15.9.2008, and therefore, appropriate direction may be issued to the regularize the services of the petitioners.

The learned Government Pleader for the respondents has not disputed the above submission.

In view of the above submissions, this Court is of the view that this writ petition can also be disposed of in terms of the judgment passed by the Hon'ble Division Bench of this Court in 19956 and 20036 of 2008 dated 15.9.2008 directing the respondents to consider the case of the petitioners for regularization of their services in terms of G.O.Ms.No.91, dated 21.6.2008 and G.O.Ms.No.59, dated 10.8.2007 and pass appropriate orders.

Accordingly, the Writ Petition is disposed of in terms of the judgment passed by Hon'ble Division Bench of this Court in W.P.Nos.19956 and 20036 of 2008 dated 15.9.2008, directing the respondents to consider the case of the petitioners for regularization of their services in terms of G.O.Ms.No.91, dated 21.6.2008 and G.O.Ms.No.59, dated 10.8.2007 and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.
