HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 21233 of 2016 ORDER:

The Petitioner-High School was established after obtaining necessary permission from the competent authority as per rules and regulations. It seeks a writ of mandamus declaring the action of the respondents in not paying the maintenance grants in terms of G.O.Ms.No.320, Education (PS.2) Department, dated 16.09.1994 for the academic years 2013-2014, 20142015 and 2015-2016, as arbitrary and illegal. When the matter is taken up for admission, the learned counsel appearing for the petitioner as well as the learned Government Pleader for School Education appearing for the respondents would submit that the issue involved in this writ petition is squarely covered by the judgments of this Court in W.P.No.19400 of 2001 dated 18.09.2001 and W.P.No.15374 of 2010, dated 02.07.2010.

Following the decisions in W.P.No.19400 of 2001 and W.P.No.15374 of 2010, the writ petition is disposed of directing the respondents to release the Maintenance Grants to the petitioner-School in terms of G.O.Ms.No.320, Education (PS-2) Department, dated

16.09.1994, within a period of three months from the date of receipt of a copy of this order, if the petitioner is otherwise entitled to. There shall be no order as to costs.
