This Civil Miscellaneous Appeal is filed under Order 43 Rule 1(r) read with Section 151 CPC assailing the order dated 24-08-2011 passed in I.A.No.1378 of 2010 in O.S.No.290 of 2010 on the file of the Court of II Additional District Judge, Visakhapatnam.

At the time of arguments, learned counsel for the appellant submitted that the purpose of filing the appeal has become infructuous.

In view of the submission made by the learned counsel for the appellant, the C.M.A. is dismissed as infructuous. As a sequel, Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
