HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No. 2035 of 2005 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) None appears for the parties.

This appeal is directed against the order, dated 08.08.2005, passed in W.P.No.13571 of 2004. The writ petition was dismissed allowing the respondents to conduct a fresh auction after giving wide publicity so that the temple will get maximum amount of rent for the leased lands.

No interim order was passed while issuing notice in October, 2005. Having regard to the nature of controversy that was raised in the writ petition, it appears that the appellants lost interest in prosecuting this appeal further and hence, no one is coming forward to work it out on merits. We are, therefore, constrained to dismiss this appeal for non-prosecution. Order accordingly.

Miscellaneous petitions, if any, shall also stand dismissed.
