Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.
This Writ Petition is filed seeking to declare the action of the 2nd respondent in not passing any orders on the stay application filed along with the appeal on 27.12.2014, as arbitrary and illegal.
Petitioner is the dealer of fair price shop No.16 of Gutlapalli Village, Bollapalli Mandal, Guntur District. After conducting enquiry, the 3rd respondent cancelled the authorization of the petitioner on 24.11.2014. Being aggrieved, the petitioner preferred an appeal to the 2nd respondent-Joint Collector on 27.12.2014.
Learned counsel appearing for the petitioner submits that the authorization of the petitioner was cancelled without conducting proper enquiry and on flimsy grounds.
In any way, since the appeal is pending with the 2nd respondent-Joint Collector, the 2nd respondent is directed to dispose of the same within a period of six weeks from the date of receipt of a copy of this order.
Till then, the impugned order dated 24.11.2014, whereunder the authorization of the petitioner was cancelled, is suspended.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
