HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8707 OF 2017 ORDER:

This writ petition is filed questioning the action of the 2nd respondent in not mutating the house property bearing No.2-4118/4/7/4, Plot No.6/8, Sy.No.63, admeasuring about 280 sq. yards, situated at Block No.4, Swaroop Nagar, Uppal, Hyderabad. Heard the learned counsel for the petitioner and the learned Government Pleader for respondents.

It is the case of the petitioner that she is the owner of the above said property having purchased the same from one Smt P.G. Kanakamma vide registered sale deed dated 16.04.2015. It is stated that consequent to the purchase of the house property, the petitioner submitted an application to the 2nd respondent on 03.06.2015, for mutation of the house property in her name along with all the relevant documents, but the 2nd respondent rejected the application of the petitioner vide proceedings dated 14.10.2015 asking the petitioner to submit the link documents. It is further state that the petitioner submitted all the relevant documents including the link document along with the mutation application, but the 2nd respondent is neither accepting the application of the petitioner nor assigning any reasons for mutation of the house property of the petitioner. Hence, the writ petition.

Learned counsel for the petitioner submits that though the petitioner submitted all the relevant documents along with the mutation application, the 2nd respondent authorities are not accepting the request of the petitioner for mutation and hence he prays to allow the writ petition.

Inasmuch as the grievance of the petitioner is for consideration of her application for mutation, the writ petition can be disposed of giving liberty to the petitioner to submit a fresh application along with all the relevant and supporting documents within a period of one week from the date of receipt of copy of this order. Thereafter, on submission of the application, the 2nd respondent-authorities shall consider the same and pass appropriate orders in accordance with the law within a period of two weeks from the date of receipt of the application from the petitioner.

With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous. ______________________________ CHALLA KODANDA RAM, J Dated:27.03.2017 Note: Issue CC forthwith.
