THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.13490 of 2025 ORDER:

The present Criminal Petition is filed praying this Court to grant pre-arrest bail to the petitioners who are arrayed as accused Nos.2, 3, 5, 7, 10 and 11, wherein the accused Nos.2 and 3 were already arrested and remanded to the judicial custody and accused Nos.10 and 11 are 15 years and 13 years, who are juvenile in Crime No.260 of 2025 of Chaderghat Police Station, Hyderabad District registered for the offences punishable under Sections 123, 305(a) r/w 3(5) of the BNS and subsequently, the Sections were altered to Sections 310(2) r/w 3 (5) of the BNS. 2.

The brief facts of the case are that, on 03.07.2025, the de-facto complainant, who is the step son of the accused No.1 lodged a report before the police stating that accused No.1 along with other accused persons, administered sedative drugs to the father of the de-facto complainant, who suffers from bipolar disorder and stolen

an amount of Rs.1.10 crore in cash, 40 tolas of gold jewellery and property documents and two original passports from his residence. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri Naraparaju Avaneesh, learned counsel for petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the de-facto complainant himself stated that his father is suffering from bipolar disorder and is taking medicines and is under medical supervision and the said facts, are intentionally suppressed by the de-facto complainant and there is no such recovery of gold and cash from the de-facto complainant's father and accused No.1 was already granted bail by this Court on 14.10.2025. It is further submitted that accused Nos.2 and 3 were already arrested and

accused Nos.10 and 11 are juvenile and custodial interrogation of accused Nos.5 and 7 is not required, as they are relatives of accused No.1. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature and the custodial interrogation is required for further investigation. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, the allegations seems to be cheating the de-facto complainant's father, whereas, accused No.1 already lodged a complaint against the father of the de-facto complainant for the alleged injuries sustained by the accused No.1 in the hands of de-facto complainant and his father and

subsequently, the present FIR is registered against the petitioners and accused Nos.2 and 3 were already arrested. Considering the facts and circumstances of the case and the custodial interrogation of other petitioners are not required, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions: i.

The petitioners shall surrender before the Station House Officer, Chaderghat Police Station, Hyderabad District, and on such surrender, the Station House Officer shall release them on bail, on their executing a personal bond for Rs.25,000/- each (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
