Heard.

The petitioner states that her husband purchased the land admeasuring Ac.10-03 gts., in Sy.No.454/9 situated at Gorita Village, Timmajipet Mandal, Mahabubnagar District, under Lavoni Rules on payment of market value and thereafter, her husband's name was incorporated in the revenue records vide File No.174/34/1954-55 and after demise of her husband, she is in continuous possession and enjoyment of the said land and her name was also incorporated in the revenue records and pattadar pass books and title deeds were also issued in her favour.

However, alleging that the aforesaid land is included erroneously by the 4th respondent in the prohibited list under Section 22-A of the Registration Act, the petitioner made a representation to the District Collector, Mahaboobnagar-2nd respondent on 27-04-2015 seeking to delete the aforesaid land from the prohibited list. The said representation is stated to be still pending with the 2nd respondent and alleging inaction, the present writ petition is filed.

As the provisio to Sub-Section 4 of Section 22-A of the Registration Act, 1908, envisages that notified category lands can be deleted after due enquiry in full or in part, it is necessary for the District Collector to consider the aforesaid petitioner's representation by examining the matter as to whether the said land is required to be treated as prohibited land and make appropriate recommendations to the Government either for confirming the Notification or for denotifying the said land. Since the aforesaid application is pending from 27-04-2015, it is appropriate for the 2nd respondent to examine the matter and make appropriate recommendation to the Government, expeditiously preferably within four weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No costs.
