No representation for the petitioner.
Heard the learned Assistant Government Pleader and perused the counter affidavit dated 31.10.2013 of respondent No.2. The petitioner prays for mandamus declaring the action of the 2nd respondent in involving in a civil dispute at the instance of respondent Nos.3 to 6 and threatening the petitioner and his relatives to come to police station regularly, as illegal and unconstitutional.
The prayer does not refer to any specific property or civil dispute, in which the grievance against the 2nd respondent is made. Be that as it may, the 2nd respondent has filed counter affidavit and in paragraph No.5 has stated thus:
"It is pertinent to submit that the dispute of the petitioner as well as the unofficial respondents 3 to 6 herein is purely civil in nature and hence this respondent police has nothing to do with it. I humbly submit that this respondent never interfered with the civil disputes much less the dispute of the petitioner herein. I humbly submit that having bore grudge against the unofficial respondents herein, the petitioner made baseless allegations against this respondent which are far from truth. I humbly submit that the allegation of the petitioner that at the instance of the unofficial respondents 3 to 6 herein, this respondent is harassing him by calling him to the police station is
SVB,J WP_29868_2013 absolutely false, baseless and hence the same is denied. All the other allegations made in the affidavit are false, baseless and the same are denied. Hence the writ petition is devoid of any merits."
The statement is placed on record.
