THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8871 of 2018 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed to quash the proceedings in Cr.No.577 of 2018 on the file of Rayachoti U/ G Police Station, Y.S.R. Kadapa District.

After arguing the matter for awhile, learned counsel for the petitioners, requested this Court to direct the concerned to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1 In view of the request made by the learned Counsel for the petitioners, the Police of Rayachoti U/ G Police Station, Y.S.R. Kadapa District, are directed to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines laid down by the Supreme Court in Arnesh Kumar's case referred supra.

With the above direction, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
