HON'BLE SRI JUSTICE DILIP B. BHOSALE CIVIL REVISION PETITION No. 999 OF 2015 P.C:

Heard learned counsel for the petitioner.

This C.R.P challenges the order dated 20-02-2015 passed on I.A No.97 of 2015 in R.A.No.29 of 2015 filed by the petitioner under Section 20(2) of the Andhra Pradesh Buildings (Lease, Rent and Eviction) Control Act, 1960 for stay of further proceedings in R.C No.423 of 2002. The application for stay has been granted subject to condition that the petitioner shall deposit disputed amount of Rs.60,600/- in the Court, with further observation that the said amount shall remain in deposit till disposal of the appeal.

Having considered the nature of order and the decree under challenge, I am not inclined to interfere with this order in revisional jurisdiction under Article 227 of the Constitution of India.

Hence, the C.R.P is dismissed.

Time to deposit the amount, as per the impugned order, at the request of learned counsel for the petitioner, is extended by another four weeks from today. On such deposit being made, the Court below is directed to pass an appropriate order investing the said amount in fixed deposit in any natioinalised bank initially for a period of one year and shall renew the fixed deposit from time to time, till the disposal of the appeal.
