The Court made the following:
ORDER:
This Writ Petition is filed for a mandamus to set-aside proceedings No.B/211/2011, dated 24-9-2011 of respondent No.3 whereby he has suspended the petitioner's fair price shop authorization in exercise of the powers vested in him under G.O.Ms.No.47, Consumer Affairs, F&CS Department, dated 6-11-2007. At the hearing, there is no representation for the petitioner. Inasmuch as under the above mentioned G.O., respondent No.3 is
empowered to suspend fair price shop authorizations only for a period of 90 days, the impugned order has ceased to be in force with the efflux of time. Hence, the Writ Petition has become infructuous and the same is accordingly dismissed as such. As a sequel to the dismissal of the Writ Petition, WPMP No.35089 of 2011 is dismissed as infructuous.
