THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.6566 of 2017 ORDER:

This criminal petition is filed by the petitioner-accused No.4, under Sections 437 and 439 of Cr.P.C., seeking bail in Crime No.117 of 2017 on the file of the Station House Officer, Anakapalli Town Police Station, Visakhapatnam Rural, registered for the offences punishable under Sections 8(c) and 20B of the Narcotic Drugs and Psychotropic Substances Act.

Heard the learned counsel for the petitioner and perused the material available on record.

Accused Nos.1 and 2 filed Criminal Petition No.6610 of 2017 under Section 438 Cr.P.C., and the same was dismissed by this Court on 07.8.2017. Accused No.3 filed Criminal Petition No.6485 of 2017 under Section 438 Cr.P.C., and the same was dismissed by this Court on 24.8.2017. The allegations made against accused Nos.1 to 3 and the petitioner herein are almost one and the same. The learned Additional Public Prosecutor submitted that the investigation is in progress.

Taking into consideration the nature of the offence alleged to have been committed by the petitioner as well as the stage of the investigation, this Court is of the considered view that it is not a fit case to grant anticipatory bail to the petitioner. 5.
