Cr l.R.C.MP.No.3 8 1 2 of 2 0 1 7 This Petition is filed under Section 147 of Negotiable Instrument Act seeking permission to compound the offence punishable under Section 138 of NI Act since the petitioner paid Rs.15,000/ - vide Receipt No.886, dt.23.08.2017 in compliance of Judgment in Dam odar S Pr abh u Vs. Say ed Baba Lal H [ AI R 2 0 1 0 SC 1 9 0 7 ) as a pre-condition to compound the offence.

Both parties are present in Court and they are identified by their respective counsel and they also furnished the copies of Aadhar Cards in proof of their identity.

The contents of the compromise are read over and explained in Telugu, they admitted the contents to be true. The complainant admitted that he received Rs.1,00,000/ - and acknowledged the receipt of the same orally in the Court. Hence, this Court find that the compromise is voluntarily and therefore, the present Petition is liable to be allowed.

Accordingly, Crl.R.C.M.P.No.3812 of 2017 is allowed. Cr l.R.C.No.2 2 4 8 of 2 0 1 7 In view of the Orders in Crl.R.C.M.P.No.3812 of 2017, this Criminal Revision Case is allowed, setting aside the conviction and sentence imposed by the trial Court, confirmed by the Appellate Court, acquitting the petitioner/ accused for the offence punishable under

Section 138 of Negotiable Instrument Act. The bail bonds executed by the petitioner/ accused shall stand cancelled. As a sequel, miscellaneous petitions, if any, pending in this case, shall stand dismissed.
