HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.2581 of 2015 ORDER:
This writ petition is filed to declare the action of the respondents in interfering and dispossessing the 1st petitioner from the land in Sy.No.350/2A to an extent of Ac.1-21 guntas and the 2nd petitioner in Sy.No.350/2AA to an extent of Ac.0-20 guntas situated at Bhainsa village and Mandal of Adilabad District as illegal and arbitrary. The case of the 1st petitioner is that the subject land was purchased by his forefathers under registered sale deed dated 12.6.1990 and the 2nd petitioner also purchased the subject land; the 3rd and 4th respondents want to widen the existing road without issuing any notice or initiating any land acquisition proceedings; on 2.2.2015, the 3rd and 4th respondents came to the lands of the petitioners and tried to dispossess them.
Counter affidavit has been filed by the 4th respondent stating that the work was completed in all respects by December, 2015 and that the respondents have neither encroached into the petitioners land nor interfered or dispossessed the petitioners from the land. In view of the categorical statement made in the counter affidavit, no further orders are necessary in the writ petition. Accordingly, the Writ Petition is closed. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
