HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No. 2586 of 2015 ORDER:
Heard.
The present revision came to be filed assailing the order dated 31.07.2015 passed in Criminal Revision Petition No.5 of 2015 on the file of the VIII Additional Sessions Judge, Ranga Reddy District, L.B.Nagar, Hyderabad, wherein an order rejecting an application filed under Section 45 of the Indian evidence Act was reversed.
Though various grounds are raised in the revision, learned counsel for the petitioner submits that if the disputed signature on Ex.P8 is to be compared with the signature made during 251 Cr.P.C. examination, definitely there would be a variation in view of lapse of time and also the possibility of accused differently signing during 251 Cr.P.C. examination. She submits that the signatures made in the year 2011 ie. the signature on the cheque which is not disputed by the accused may be sent to handwriting expert for comparison instead of the signature made during 251 Cr.P.C. examination.
Learned counsel for the respondent did not raise any dispute with regard to the said aspect.
In view of the above, the order dated 31.07.2015 passed in Crl.R.P.No.5 of 2015 is modified by directing the trial court to send Ex.P8 original receipt along with Ex.P1-cheque for comparison with the disputed signature on Ex.P8 receipt dated 11.03.2011.
With the above modification, the Criminal Revision Case is disposed of.
As a sequel thereto, Miscellaneous Petitions pending if any in this Crl.R.C. shall stand closed.
