THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20429 of 2017 ORDER:
The petitioners are working as Constables and they stood surety for their colleague who availed loan facility from the third respondent. It appears that pursuant to the decree passed by the second respondent, a demand notice in E.P.No.15/PL109/Sec/2017, dated 31.01.2017, was issued asking the petitioners to appear before the second respondent.
Accordingly, they appeared and asked for a copy of the proceedings in CR No.12/PL-109/Sec/2016. However, no copy was furnished to them. But, an order of attachment was issued by the second respondent by proceedings dated 21.03.2017. It is fairly submitted by the learned Counsel for the petitioners that the order of attachment has come into operation. However, in order to avail the remedy of appeal against the main decree passed by the second respondent, learned Counsel for the petitioners submits that an appropriate direction be issued to the second respondent to furnish a copy of the award passed by him in the proceedings initiated by the third respondent.
In view of the nature of relief sought, this Writ Petition is disposed of directing the second respondent to furnish a copy of the award in CR No.12/PL-109/Sec/2016, dated 17.01.2017, within a period of two weeks from the date of receipt of a copy of
this order. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
