This Criminal Petition is filed seeking the Court to enlarge the petitioner, on bail, who is arrayed as accused No.4 in Crime No.117 of 2018 of Central Crime Police Station, Hyderabad. 2.
The brief facts of the case are that on 18.06.2018 a complaint was received from LW-1 stating that M/s KMJ Land Developers India Ltd., represented by its Director, Mr. Santhoshilal Rathore/accused No.1, and others had collected huge amounts from the public under the guise of real estate schemes promising land allotments and refunds with interest. Basing on the said complaint, the Sub-Inspector of Police, Central Crime Station, Detective Department, Hyderabad City, registered a case in Crime No.117 of 2018.

Heard Sri Abhilash Sontake, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner/accused No.4 was falsely implicated in the case and had no active role in the collection of deposits or management of the company's affairs and that he was neither a director nor a person in charge of the day-to-day business of M/s KMJ Land Developers India Ltd., and his name was included merely on suspicion. He contended that the petitioner had no connection with the alleged fraudulent schemes or with the complainant's transactions and that the main responsibility, if any, rested with the Managing Director and other key office bearers of the company. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioner, stating that the allegations leveled against the petitioner are serious in nature. Further, there are number of victims in the hands of the petitioner and that the investigation as not yet completed. There are 16 crimes are pending against the petitioner. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that the petitioner was arrayed as accused No.4. As seen from the record, the material part of the investigation has been completed and the charge sheet has also been filed. Further, the petitioner has been in jail since 16.08.2023. Considering the facts and circumstances of the case, as well as the period of incarceration of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Sessions Judge, Hyderabad.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
