THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.21038 OF 2016 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner to declare the action of the respondent No.3 in issuing final notice vide Rc.No.E2/3177/2010 dated 22.06.2016 by postponing the case years together is illegal, arbitrary and against the principles of natural justice. Learned Government Pleader for the State based on the written instructions received from the Collector, Prakasam District, Ongole submitted that the then Joint Collector was transferred, later the matter was re-opened by the present Joint Collector and posted the matter for final hearing and for passing final orders in accordance with law and placed on record the written instructions received from the District Collector, Prakasam District, Ongole.

In view of the written instructions received by the learned Government Pleader for the State, the Joint Collector concerned is directed to dispose of the appeal pending before him/her within 15 days from the date of receipt of a copy of this Order. With the above direction, without touching the merits of the case, the writ petition is disposed of. No costs. The miscellaneous petitions pending, if any, shall also stand closed.
