ORDER:

Feeling aggrieved by the purported inaction of respondent No.2 in considering their representation for taking action against respondent No.3 for encroaching upon 40 feet wide public road leading from Bypass Road to the Church at Balaji Nagar Colony of Kalvakunta Revenue Village, Sangareddy Town, Medak District, the petitioners filed this writ petition.

At the hearing, learned counsel representing Mr.N.Praveen Kumar, learned standing counsel for Municipalities (TS), on instructions from respondent No.2, has submitted that on the petitioners' complaint, respondent No.2 has issued a notice to both the parties requesting them to appear before him on 10.02.2016 with their respective documents and that after examining the same, respondent No.2 will take an appropriate action, if it is found that respondent No.3 has encroached upon any part of the existing or proposed public road. In view of the above submissions of the learned counsel representing respondent No.2, the said respondent is directed to do the needful as reported by his counsel within a period of one month from the date of receipt of a copy of this order. Subject to the above direction, the Writ Petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.Nos.4784 and 4786 of 2016 filed by the petitioners for interim reliefs shall stand disposed of as infructuous.
