Heard learned counsel for the petitioner and the learned Government Pleader for G.A.D, Finance & Planning.

The learned Government Pleader would point out that, entertaining W.P.No.30204 of 2014 this Court passed an interlocutory order on 14.10.2014 in WPMP.No.37748 of 2014 moved therein, whereas, no such orders have been passed by this Court which dealt with W.P.No.30453 of 2014. However, since the subject matter for consideration in both the cases is identical, both the cases are clubbed together. Therefore, on 29.01.2015, an order is passed by this Court which reads as under: "Interim order granted earlier by this Court shall stand extended by a further period of two (2) weeks." Learned counsel for the petitioner would contend that when once both the cases are clubbed together and when once this Court has extended the interim order passed in WP.No.

30204 of 2014, it goes without saying that the same interim order is treated to have been passed even in W.P.No.30453 of 2014. That is the reason why this Court has passed a common order on 29.01.2015 in both the cases. Otherwise, there is no necessity for this Court to have passed a common order in both the cases. Per contra, the learned Government Pleader would contend that when once no interim order is passed in W.P.No.30453 of 2014, the question of extension of such an order would not arise. After having given my consideration to the rival submissions, I find much force in the submissions made by the learned Government Pleader. It goes without saying that when an interlocutory order is passed confining its operation for a limited period, then the question of its extension would arise for consideration of the Court.

However, when once it emerges that no interim order is passed in W.P.No30453 of 2014 granting extension of a non-existing interim order would not simply arise. However, it should be explained, when two or more cases are clubbed and some of the cases carry interlocutory order, when a common extension order is passed, it only conveys that the interim order passed in the case concerned stands extended. Otherwise, the Court cannot be construed to have passed an order of extension to a non-existing order. I, am therefore, convinced that the action of the respondents cannot be faulted upon the premises that the respondents have deliberately, wantonly and purposefully violated the earlier order. Hence, this contempt case is dismissed. Consequently, miscellaneous applications if any shall also stand dismissed. No costs.
