HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.30028 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents in interfering with the construction of building by the petitioner carried under building permit order in File No.2/C12/02953/2018 in Permit No.2/C12/07475/2018, dated 30-04-2018 in Plot No.4 in Sy.No.41/5 situated at Khanamet Village, Serilingampalli Mandal, Ranga Reddy District, as illegal and arbitrary.

Learned counsel for the petitioner submits that the respondents are interfering with the construction activity of the petitioner without following due process of law, though petitioner has a valid building permit.

Learned Government Pleader for Revenue on instructions submits that the land in Sy.No.41/5 admeasuring Ac.252.24 guntas is classified as sarkari i.e., Government land. Subsequently, the said survey number was sub-divided into sub-divisions and was assigned to various persons. As per the records available in the office, the land in Sy.No.41/5 to an extent of Ac.2-00 guntas was assigned to Sadaku Ramaiah with a condition not to alienate the land assigned. Whereas, the assignee in contravention to the assignment conditions converted the said land into plots and disposed of the same to various persons. As such, the

said land was resumed under POT Act and entered in the list of prohibited properties notified under Section 22-A of the Registration Act, 1908. Since the land in question is government assigned land and the assignee in contravention of the rules and conditions has disposed of the same to the petitioner, the authorities have stopped the work undertaken by the petitioner.

Having regard to the facts stated above, the writ petition is disposed of directing the 4th respondent not to interfere with the construction activity of the petitioner in Plot No.4 in Sy.No.41/5 situated at Khanamet Village, Serilingampalli Mandal, Ranga Reddy District, without following due process of law. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
