THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT PETITION No.13130 OF 2013 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

"to issue a Writ, Order, or Direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondent authorities in insisting for implementation of S.O 2534 (E) on 11.11.2011 issued by respondent No.1 without taking steps to see that all the mandated provisions of i) Standards of quality of service (Digital Addressable cable T V system) Regulations 2012 (12 of 2012) ii) Consumers complaint Redressal (Digital Addressable cable T V system) Regulations 2012 (13 of 2012) iii) The Tele communication (Broadcasting and cable services) interconnection (Digital Addressable Cable Telecom System) (First amendment) Regulations 2012 (14/2012) are complied with as illegal and unconstitutional and consequently declare that unless the Telecom Regulatory Authorities certifies all the mechanism mentioned in the regulations are fully operational the implementation of S.O 2534 (E) on 11.11.2011 issued by Respondent No.1 and the consequential penal actions including cutting off the cable signal has to be deferred." 2.

Heard the learned counsel appearing for both sides and perused the record.

In the course of submissions, it is brought to the notice of this Court by both the learned counsel that time and again, new regulations have come into force and they are being followed by the authorities concerned.

In view of the above submission, nothing survives for adjudication in this Writ Petition.
