This writ petition is filed for a writ of mandamus declaring the action of the respondents-authorities in not supplying the essential commodities to the petitioner's fair price shop No.24 at Venugopalapuram village, B.N.Kandriga Mandal, Chittoor District, without any disci0plinary proceedings and during the subsistence of valid authorisation, as illegal and arbitrary.
The case of the petitioner is that his fair price shop No.24 at Venugopalapuram village, B.N.Kandriga Mandal, Chittoor District was inspected by the authorities on 21.08.2014 and seized certain stocks. Thereafter without giving any notice, the respondents-authorities stopped supply of stocks to the petitioner's fair price shop for distribution of the same to the cardholders, though he is having valid and subsisting authorisation. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies. Since it is stated that the petitioner is having valid and subsisting authorisation of fair price shop dealership, the respondents-authorities are directed to supply the essential commodities to the petitioner's fair price shop, as long as his authorisation is valid and subsisting. However, this order will not preclude the competent authority from taking appropriate action against the petitioner, if petitioner has committed any violation.
With the above observations, writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
