THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.6708 of 2016 ORDER:

The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Cr.No.404 of 2015 of Narayanaguda Police Station, Hyderabad.

Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor, representing the State. Basing on the private complaint lodged by the respondents 2 and 3/complainants, the Court of VIII Metropolitan Magistrate, Cyberabad at Rajendranagar referred the matter to the police and accordingly, the police registered a case against the petitioners herein for the offences punishable under Sections 420, 403, 468, 506 IPC read with Section 34 IPC and Section 156 (3) Cr.PC. The allegations levelled in the complaint, prima facie, reveal the commission of offences, as alleged. This is a matter, which requires investigation by the police. There are no valid grounds to quash the First Information Report. In the facts and circumstances of the case, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, shall not arrest the petitioners/A-1 and A-2 till the investigation is completed and charge sheet is filed.

Pending miscellaneous applications, if any, shall stand closed in consequence.
