THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.29890 OF 2018 ORDER:

When the matter is taken up, it is submitted by learned counsel for the petitioner so also learned Government Pleader that the issue in the present writ petition is squarely covered by the order, dated 16.08.2018, in W.P.No.28109 of 2018 of this Court. A copy of the same is placed on record.

Following the said order and for the reasons stated therein, this writ petition is also allowed, setting aside the impugned Order passed by the Deputy Director of Mines and Geology/R.3 issued vide proceedings No.1254/QL/SRD/2018, dated 28.07.2018. However, it is open for the State Government to initiate action and to pass appropriate Orders, if they are so advised to do so, in accordance with the provisions of Rule 11 of the Telangana State Minor Mineral Concession Rules, 1966.

Office to enclose a copy of the order, dated 16.08.2018, in W.P.No.28109 of 2018, to this order.
