The Court made the following:

HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

This writ petition is filed seeking following prayer: "To declare the impugned action of the respondent banks in not earmarking any posts for in-service employees of Primary Agricultural Cooperative Societies and further prescribing the age as 18 years - 30 years only while not extending any such relaxation in favour of the inservice employees of Primary Agricultural Cooperative Societies in the impugned notification dated 09.10.2015 for the post of Staff Assistants/Clerks in their respective banks while extending such relaxation to other categories upto 50 years as highly illegal, arbitrary, violative of Articles 14 and 16 of the Constitution of India and consequential direction to the respondents to consider the petitioners upon receiving their applications manually to the posts of Staff Assistant/Clerk notified in the said notification without reference to the age limit".

When the matter is taken up for consideration, learned counsel representing petitioners states that petitioners are not subjected to selection process on the ground that they have not applied Online as per the recruitment notification dated 09.10.2015 and the selections are already finalized and, therefore, the cause in the writ petition do not survive. Learned counsel further submits that having regard to the fact that as the selections are already finalized, petitioners are not intending to prosecute the writ petition at the present stage and liberty may be given to them to prosecute their remedies otherwise available to them with reference to the provision of channel for appointments to the post of Staff Assistants/Clerks in the District Cooperative Central Banks.

Having regard to the submissions made, the writ petition is dismissed as infructuous, leaving it open to the petitioners to work out their remedies as available in law with reference to their claim for appointments as Staff Assistants/Clerks in the District Cooperative Central Banks. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
