HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 29836 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 3rd respondent in interfering with peaceful possession and enjoyment of petitioner's patta land to an extent of Ac.1.0400 gts., in Sy.No.271/ A/ 3, Ac.6.2800 gts., in Sy.No.271/ B and Ac.1.2000 gts., in Sy.No.270/ B in total Ac.8.5200 gts., in Bommakal Village, Pedavangada Mandal, Mahabubabad District, as illegal, arbitrary and violative of principles of natural justice.
2) At the time when the matter is taken up for hearing, the Government Pleader for Revenue placed on record the written instructions received by him, wherein it is stated that the averments in the affidavit filed in support of the writ petition are false and that the respondents never interfered with the possession of the petitioner over the subject property. According to him, no enquiry has been conducted by the Tahsildar or Village Revenue Officer, pertaining to the patta land, but the same is disputed by the learned counsel for the petitioner. 3) Recording the submission made by the learned Government Pleader for Revenue, the writ petition is closed. However, if any action is to be taken, the third respondent shall follow due process of law.
4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
