ORDER:

This writ petition is filed for a mandamus to declare the action of the respondents in creating new fair price shops without following the norms regarding allotment of minimum number of cards per fair price shop as prescribed in G.O.Ms.No.35, dated 17.09.2007, as illegal and arbitrary.

At the hearing, Mr.K.Gani Reddy, learned counsel for the petitioners, submitted that the cause in the writ petition does not survive for adjudication.

In view of the above submission, the Writ Petition is dismissed as infructuous.

As a sequel to dismissal of the writ petition, interim order, dated 31.12.2008, in W.P.M.P.No.37869 of is vacated and W.P.M.P.No.37869 of 2008 filed by the petitioners for interim relief shall stand dismissed as infructuous.
