HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 29888 of 2018 ORDER:
1) Heard learned counsel for the petitioner and Government Pleader for Revenue (AP). With the consent of both the parties, the writ petition being heard at the admission stage itself.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 2nd respondent in not adjudicating Appeal dated 16.04.2018, as arbitrary, illegal and contrary to law.
3) Though various grounds are raised in the writ petition, the grievance of the petitioner is that though the appeal was filed on 16.04.2018, till date no orders passed in the appeal. 4) The Government Pleader for Revenue (AP) submits that a direction may be issued for an early disposal of the appeal. 5) Without going into the merits of the case and having regard to the arguments advanced, the present writ petition is disposed of, directing the 2nd third respondent to dispose of the appeal dated 16.04.2018, or the stay application filed along with the appeal, after hearing all the concerned including the petitioner, in accordance with law, as expeditiously as possible, preferably, within a period of three
to five months from the date of receipt of a copy of the order. There shall be no order as to costs. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
