HON'BLE SRI JUSTICE S.V. BHATT W.P. No.18228 OF 2012 ORDER:

The petitioner prays for the following relief: " ..writ of Mandamus declaring the action of the Respondents in marking godown, guest house and compound wall of the Petitioner Company without conducting survey and without paying compensation as illegal arbitrary and violative of Article 21 of the Constitution and consequently direct the Respondents to conduct proper survey and pay compensation for the additional area of structures required from the Petitioner Company.."

Respondent No.1 filed counter affidavit substantially denying all the allegations in the writ affidavit. The petitioner filed reply affidavit dated 20.01.2014 and has slightly changed the prayer. The petitioner submitted representation dated 16.01.2014 bringing out a few grievances to the notice of 1st respondent. Mr.V.Raghu submits that the petitioner is satisfied, if a direction is issued to respondents to consider representation dated 16.01.2014 and pass orders within reasonable time. The learned Government Pleader does not object to the limited submission of petitioner. The writ petition is disposed of by this order: The petitioner is given liberty to re-submit representation dated 16.01.2014 to 1st respondent along with copy of this order within six weeks from today. The 1st respondent examines the grievance and passes order as deems fit within eight weeks from the date of re-submission of representation.

No order as to costs.
