HON'BLE Dr.JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.10217 of 2022 ORDER:

Heard the submission of Dr.Challa Srinivasa Reddy, learned counsel for the petitioner as well as the learned Additional Public Prosecutor who is representing the respondent.

The present Criminal Petition is filed seeking the Court to relax the condition that is imposed by the Court of Special Sessions Judge for NDPS cases, Hanumakonda, in CRl.M.P.No.287 of 2022 in COR.No.29 of 2022 of Prohibition and Excise Station, Kazipet, dated 15.09.2022. While allowing the petition filed by the petitioner for grant of bail, the Court directed the petitioner to execute a personal bond for Rs.50,000/- with two sureties for like sum each and ordered that one surety must be local resident of the place of the petitioner/accused. 3.

Learned counsel for the petitioner states that the petitioner is in judicial custody since more than 100 days and through bail is granted, the petitioner is unable to

secure any surety from his place i.e. from Odissa State and therefore, the said condition may be relaxed. 4.

This Court does not find any ground to disallow the said request. The fact that though the bail was granted on 15.09.2022, the petitioner is still in judicial custody itself goes to show that the petitioner is unable to produce solvency as ordered.

Hence, this Court considers desirable to relax the condition as prayed for.

The petitioner is permitted to execute personal bond for Rs.50,000/- with two sureties for like-sum each to the satisfaction of the concerned Court. The Court is directed not to insist for the sureties, either from the place of residence of the petitioner or of any other place. It is suffice if the sureties are of the citizens of India.
