HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.16117 OF 2009 ORDER:
The petitioner has filed this Writ Petition questioning the action of the respondents in directing him to vacate the garage and to deliver vacant possession to the A.P. Housing Board. By way of an interim order in WPMP No.21152 of 2009 dated 05.08.2009, this Court directed the respondents not to evict the petitioner from the subject property, but made it clear that this order would not preclude the competent authority from taking action in accordance with law. The interim order passed in this Writ Petition is based on an earlier interim order passed in WPMP No.9951 of 2009 in W.P. No.7576 of 2009 dated 09.04.2009. The said Writ Petition No.7576 of 2009 was dismissed as infructuous by order dated 16.09.2005. It is evident that the A.P.
Housing Board has taken action against all those who were in possession of the garage, and it is pursuant thereto that they have been evicted. The cause in the Writ Petition does not survive necessitating any further adjudication by this Court. The Writ Petition is dismissed as infructuous. The miscellaneous petitions pending, if any, shall stand closed. No costs.
