Smt Anjinamma, v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.20805 OF 2015 DATED 08th JULY, 2015 Between:
Smt. Anjinamma and others .. Petitioners and The State of Andhra Pradesh rep. by its Principal Secretary, Revenue Department and others .. Respondents
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.20805 OF 2015
O R D E R
This writ petition is filed against the order dated 29.06.2015 passed by the Revenue Divisional Officer, Penukonda. Perusal of the said order reflects that a revision (wrongly mentioned as appeal) lies against the same to the Joint Collector, Anantapur. However, bypassing the statutory revisionary remedy, the petitioners chose to approach this Court. As an efficacious alternative remedy is provided by the statute to the petitioners, which would be wider in ambit, this Court is of the opinion that it would be in the interests of the petitioners to avail the revisionary remedy, as disputed questions of fact would not be examined by this Court in a writ petition. The writ petition is therefore dismissed leaving it open to the petitioners to avail the statutory revisionary remedy in accordance with law. Pending miscellaneous petitions shall also stand dismissed in the light of this final order. No order as to costs. ______________________ SANJAY KUMAR, J 08th JULY, 2015 Svv
