THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2907 of 2016 ORDER:

Heard the learned counsel for the petitioner/A.1 and the learned Public Prosecutor.

2. The petitioner/A.1 filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.05 of 2016 of Keshavapatnam Police Station, Karimnagar, registered for the offences punishable under Sections 420, 468 and 471 IPC.

3. The case of the prosecution is that A.2 told L.Ws.2 to 4 that he knows some persons in Hyderabad who will arrange Ware House Assistant Grade-II jobs in Central Ware Housing Corporation, Hyderabad and took them to the said office at Hyderabad and introduced them to A.2 to A.4. In turn A.2 to A.4 made L.Ws.2 to 4 to believe their words and A.1 to A.4 asked them to give Rs.2,50,000/- each for providing job. Believing the words, L.Ws.2 and 3 gave an amount of Rs.1,00,000/- each in the 1st Floor at Indira Lodge, Koti, Hyderabad. After one hour, A.l to A.4 gave fake letter of offer of employment and instructed them to report on 12.10.2015 at Hyderabad along with the documents. Similarly, on 04.11.2015, L.W.4 gave an amount of Rs.1,00,000/- to A.1 to A.4 at Koti, Hyderabad, wherein they gave a fake offer letter asking him to report on 26.11.2015 at Hyderabad along with documents.

4. Learned counsel for the petitioners submitted that the petitioners are innocents of the offences alleged against them and a false case has been foisted against them. He further submitted that since the entire investigation is complete, the request of the petitioners can be considered.

5. A perusal of the averments in the First Information Report discloses that all the accused persons conspired together and collected huge

amounts promising to provide employment to L.Ws.2 to 4 and after collecting money gave fake offer letters asking them to report at Hyderabad along with the documents. Since the allegations made of are grave and serious in nature, the request of the petitioner cannot be considered.

6. Hence, I am not inclined to grant anticipatory bail to the petitioner.
