HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 2346 of 2016 ORDER:

It is submitted that in pursuance of the orders of this Court in W.P.No.30592 of 2011 dated 22.02.2012, necessary enquiry has been conducted with regard to the petitioners, who are found to be eligible for grant of house sites, and appropriate action is already taken. It is also submitted that 42 household pattas were granted to the petitioners under RCB/295/2011 dated 05.02.2015 and on 15.02.2015 the plots were demarcated and handed over to the allottees on 21.10.2015. All the plot holders have signed before the Mandal Surveyor accepting the possession and enjoying the plots and constructing temporary structures.

Since interference is alleged, the Government Pleader for revenue appearing for respondents 1 to 4 was required to get instructions. While confirming the possession of 42 eligible beneficiaries, he contends that the President of Sri Lakshmi Chennakesavaswamy Balaheena Vargala Welfare Society, Ongole, filed a complaint before the A.P.

State Commission for Scheduled Castes and Scheduled Tribes, Hyderabad, and also before the Joint Collector & District Magistrate,

Prakasam District, Ongole, levelling certain allegations against the petitioners and the then Revenue Officials, for which a discrete enquiry has been conducted. Further, the allegation of the petitioners that there is a physical interference with the peaceful possession and enjoyment of their property by the revenue authorities, is denied. From the above, it is clear that there is no interference by the revenue authorities. Hence, no further orders are required.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
