seeking to relax condition Nos.(ii) and (ix) in the operative portion the order dated 06.12.2024 in Crl.P. No.10094 of 2022.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Learned counsel for the petitioner submitted that while granting bail to the petitioner, this Court had imposed conditions that in case, the petitioner holds a passport, he shall surrender the same and that he shall not leave India without previous permission of the court concerned i.e. condition Nos.(ii) and (ix), apart from other conditions. Imposition of the said conditions had resulted in his passport getting impounded and restricted him from traveling abroad and as such, it resulted in being unable to cater to his business and professional requirements.

The petitioner on account of such restrictions was unable to fly abroad to attend to meetings, consultations and negotiations, which resulted in procedural and administrative delays in his business, and continuation of the said conditions were enhancing

Crl.P. No.10094 of 2024 his problems and as such, prayed to relax the above said conditions.

The learned Additional Public Prosecutor reported that the entire investigation was completed and charge sheet was filed and the trial court had also taken cognizance of the case as CC No.2604 of 2023.

Perused the record. Considering the submissions of both the learned counsel and considering the allegations against the petitioner, which were under Sections 420, 506 and 386 of IPC, and the petitioner was complying with all the conditions till date scrupulously and as it was reported that the next date of hearing of the case was on 15.04.2024 and the petitioner was undertaking to appear before the court by that date, it is considered fit to relax the condition No.(ii) only, and it is not considered fit to relax the condition No.(ix).

Accordingly, the application is allowed in part and condition No.(ii) in the operative portion of the order dated 06.12.2024 in Crl.P. No.10094 of 2022 is hereby relaxed and the trial court is directed to release the passport of the petitioner. However, the petitioner shall comply with the condition No.(ix) of the said order and shall not leave the country without prior permission of the court.
