THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.23583 OF 2017 ORDER:
This Writ Petition is filed seeking the following relief: "...to issue a writ, order or direction more particularly one in the nature of a writ of mandamus declaring the action of the 3rd respondent in permitting the 4th respondent to open rowdy sheet against me vide order dt.25-12-2015 and consequential opening of a rowdy sheets vide Rowdy Sheet No.43 by the 4th respondent Kasibugga Police Station, Srikakulam District and contrary to the Police Standing Orders as illegal, arbitrary and violative of Art.19 and 21 of the Constitution of India and consequently direct the respondents to remove the said rowdy sheet forthwith and pay compensation for the mental agony suffered by me in view of the illegal, arbitrary and abuse of power of the respondents and pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case."
Heard the learned counsel for the petitioner. Learned Government Pleader on instructions submits that though Rowdy Sheet No.43 has been opened against the petitioner, the record does not disclose any representation having been received by the 2nd respondent for closure of the rowdy sheet opened against the petitioner. In the circumstances and in the facts of the present case, Writ Petition is disposed of giving liberty to the petitioner to file a detailed representation to the 2nd respondent stating as to why a rowdy sheet opened against him shall not be continued, and the same shall be considered and disposed of by the 2nd respondent within a period of eight weeks from the date of receipt of the said representation from the petitioner, in accordance with law. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall also stand closed.
