Mr.Deepak Misra, appearing for petitioner after arguing the matter for some time and having regard to the nature of enquiry required for deciding in whose favour the record of rights are maintained or changed, does not press the writ prayer, and seeks liberty to avail the remedy of appeal.

The writ petition is dismissed, by granting the liberty as prayed for. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, also stand disposed of.
