THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33224 of 2011 ORDER:

The grievance of the petitioners in this case was that the police authorities were not taking action against respondents 4 to 31 despite their complaints dated 07.10.2011 and 29.11.2011. It was their case that they were cultivating an acre of Government land wherein they were growing cashew crop but respondents 4 to 31 bore a grudge against them and had resorted to highhanded physical action.

The Sub-Inspector of Police, Santhabommali Police Station, furnished written instructions dated 19.12.2011 to the Office of the learned Government Pleader for Home wherein he stated as under:

There is an extent of Acs.100.00 cents of Government land adjacent to Pittavanipeta Village and about 25 families had encroached there upon and raised cashew crop. The petitioners were stated to have occupied about Ac.1.50 cents. The village elders decided to distribute this land amongst the villagers equally. However, the petitioners objected to the same and submitted a representation to Santhabommali Police Station on 01.11.2011 which was taken on file as reception petition No.125/11. Again on 08.12.2011, the petitioners were stated to have given a report to

Santhabommali Police Station, which was taken on file as reception petition No.138/11, wherein they alleged that some of the unofficial respondents had resorted to cutting the cashew trees on their land. The Sub-Inspector of Police, Santhabommali Police Station, along with the Tahsildar, Santhabommali, visited the Village and conducted a meeting with the villagers. The Tahsildar was said to have warned the villagers not to resort to such disruptive activities otherwise the entire Government land occupied by them would be resumed. The villagers there upon promised the Tahsildar that they would not raise disputes. The Sub-Inspector of Police, Santhabommali Police Station, stated that the situation in the Village was peaceful thereafter.

In the light of the afore-stated facts, without going into the merits of the matter, this Court is of the opinion that the writ petition can be closed leaving it open to the petitioners to take recourse to law in the event any necessity arises in future.

The writ petition is dismissed subject to the above observation.

Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
