This transfer petition is filed seeking to withdraw the suit in OS.No.240 of 2012, on the file of the XIV Additional District Judge Court, Vijayawada and transfer the same to the Court of VIII Additional District and Sessions Judge (FTC), Vijayawada and to club with OS.No.125 of 2008. Today, when the matter is taken up for hearing, learned counsel for the respondent stated that already OS.No.240 of 2012 is transferred to the Court of VIII Additional District and Sessions Judge, Vijayawada, on administrative grounds. The same is not disputed by the learned counsel for the petitioner. But, the counsel for the petitioner pleaded that both the suits i.e. OS.No.240/2012 and OS.NO.125/2008 should be clubbed together. Since already, on administrative grounds, the suit in OS.No.240/2012 is transferred to the Court of VIII Additional District and Sessions Judge, Vijayawada, it is open for the petitioner to seek relief with regard to clubbing of the suits before the appropriate Court.

Accordingly, the Transfer CMP is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, shall stand closed.
