HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.46869 of 2016 ORDER:

This writ petition is filed seeking issuance of Mandamus declaring the action of respondent No.3 in seeking to issue Pattadar Pass Book in respect of Acs.3.30 cents in Sy.No.748/2 of Puthalapattu Village and Mandal, Chittoor District, belonging to the petitioner in favour of respondent No.5, as illegal and arbitrary and consequently, sought to set aside the notice in ROC.No.A/771/2011, dated 22.09.2014 issued by respondent No.3.

Sri Vigneswara Swamy Devasthanam, Puthalapattu Village and Mandal, Chittoor District, to which the petitioner is a Dharma Kartha, is in possession of various extents of land. While so, the 3rd respondent - Tahsildar, Puthalapattu Village, issued a notice calling for objections, if any, for issuing Pattadar Pass Books in respect of agricultural land admeasuring Acs.3.30 cents in Sy.No.748/2 of Puthalapattu Village and Mandal, Chittoor District, in favour of unofficial respondent No.5. It is said that inspite of bringing to the notice of the authorities that the land belongs to the petitioner - Temple and that there are prohibitory orders issued by the 4th respondent in respect of the said land, the 3rd respondent is trying to issue Pattadar Pass Books in respect of the said land to the unofficial respondent No.5. Hence, the present writ petition. 3.

Heard learned counsel for the petitioner and the learned Government Pleader for Revenue.

The grievance of the petitioner appears to be that the authorities are trying to issue Pattadar Pass Books in respect of the subject land in favour of unofficial respondent No.5, though he is not entitled to, without taking into consideration the objections raised by the petitioner.

On the other hand, the learned Government Pleader for Revenue submits that if the petitioner has any objection for the same, he can raise the same before the authorities concerned and the same will be considered in accordance with law.

Having regard to the submissions made by both the parties, this writ petition is disposed of directing the 3rd respondent - Tahsildar, Puthalapattu Village and Mandal, Chittoor District, to hear and take into consideration the objections raised by the petitioner before issuing Pattadar Pass Books and title deeds in respect of agricultural land admeasuring Acs.3.30 cents in Sy.No.748/2 of Puthalapattu Village and Mandal, Chittoor District, in favour of unofficial respondent No.5 and thereafter pass appropriate orders in accordance with law. He is further directed to communicate a copy of the order to the petitioner. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
