THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.29939 of 2018 ORDER:
Heard learned counsel for the petitioner, learned Government Pleaders for Municipal Administration and Urban Development and Revenue appearing for respondent Nos.1 and 3 respectively and Sri Pasam Krishna Reddy, learned Standing Counsel for GHMC appearing for the second respondent, apart from perusing the material on record.
When the matter is taken up, written instructions, dated 23.08.2018, furnished by the Tahsildar, Bandlaguda Mandal to the office of the learned Government Pleader, are placed on record by the learned Government Pleader. According to the said instructions petitioner herein filed O.S.No.1369 of 2013, seeking permanent injunction restraining the Tahsildar, Bandlaguda and his subordinates from causing interference into the peaceful possession and enjoyment over the suit schedule property bearing Municipal No.19-4-14/26 to 30, admeasuring 500 sq.yards equivalent to 418.05 sq.mts, and the said suit was dismissed by the VIII Junior Civil Judge, City Civil Court, Hyderabad on 16.03.2015. It is further stated that the petition schedule property was proposed for construction of a community hall, at the request of the local people, and that the petitioner herein filed an application seeking regularization under G.O.Ms.No.59, vide No.APLHYD161210000007, to an extent of 431 sq.yards and paid a sum of Rs.15,000/- and that
during the course of verification of the said application, it was found that the land was open and covered by a compound wall and the petitioner was not in possession and occupation of the application schedule land and, accordingly, the said application was rejected. In view of the above instructions, having regard to the fact that the petitioner herein failed before the civil Court and, as the application of the petitioner herein for regularization was also rejected by the respondent authorities, this Court does not find any merits in the Writ Petition.
Accordingly, Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions pending, if any, in this Writ Petition, shall stand closed.
