HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.626 of 2015 ORDER:
This petition is filed to withdraw H.M.O.P.No.40 of 2015 from the file of Senior Civil Judge, Rajam, Srikakulam District and transfer the same to Family Court, Visakhapatnam District.
2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 07.11.2012 at Devi Sri Devi Kalyana Mandapam, Rajam as per Hindu rites and caste customs and after marriage she and respondent lived at Allipuram in Visakhapatnam where respondent used to work as cook in a hotel at Visakhapatnam and due to disputes between parties respondent filed H.M.O.P.No.40 of 2015 with false and untenable allegations at Rajam. She stated that she is living with her old parents at Visakhapatnam and it is difficult for her to travel from Visakhapatnam to Rajam, which is approximately 150 KMs. She stated that OP is filed at Rajam only with a view to harass her and by taking her convenience the O.P. pending on the file of Senior Civil Judge, Rajam has to be withdrawn and transferred to Senior Civil Judge, Visakhapatnam.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

5. Considering the reasons stated in the affidavit and also considering the convenience of wife, H.M.O.P.No.40 of 2015 is withdrawn from the file of Senior Civil Judge, Rajam, Srikakulam District and transferred to Family Court, Visakhapatnam District
for disposal in accordance with law.
6. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. __________________ S. RAVI KUMAR, J Date: 10-03-2016 gvl
