All the petitioners were issued valid caste certificates in the year 2013 after conducting regular enquiry by the competent authority, but all of a sudden without issuing notice to them, their certificates were deleted from online website. Aggrieved by the same, the present writ petition is filed.
Learned Assistant Government Pleader for Social Welfare basing on written instructions submits that the petitioners belong to Scheduled Caste category, but they are claiming certificates as Scheduled Tribe. But learned Assistant Government Pleader could not dispute the assertions made by the petitioners that they were issued certificates as belong to Scheduled Tribe. As on today, the caste certificates issued to the petitioners are valid. As long as caste certificates issued to the petitioners are valid, they could not have been deleted from the website by the respondents. In view of the same, there shall be direction to the respondents to upload the Caste and Community certificates of the petitioners in online website. However, this order will not preclude the respondent-authorities from taking action, if the said certificates found to be illegal as per the provisions of law. With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
